Throughout the site, the terms “we”, “us” and “our” refer strictly to Trinity Digital Company d/b/a Onyx Customs FL. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your absolute acceptance of all terms, conditions, policies, and notices stated here.

SECTION 1 - ONLINE STORE TERMS By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to traffic, safety, and environmental regulations).

SECTION 2 - GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks via our PCI-compliant payment gateways.

 

SECTION 3 - AUTOMOTIVE DISCLAIMERS & FEDERAL EPA COMPLIANCE (CRITICAL)

 

  • 3.1 Professional Installation Required: All high-performance components sold by Onyx Customs FL are intended for installation by certified automotive professionals. We assume zero liability for any damages, injuries, vehicle fires, or mechanical failures resulting from improper installation or user error.

     

  • 3.2 Emissions & "Defeat Device" Disclaimer: Certain products (including but not limited to exhaust decat systems, oxygen sensor spacers, and ECU tuners) may be considered "Defeat Devices" under the Federal Clean Air Act. These items are sold strictly for "Competition/Off-Road Use Only" on dedicated, unregistered racing vehicles operating on closed circuits.

     

  • 3.3 Customer Legal Responsibility: It is your sole, undeniable responsibility to verify compliance with all local, state (including California CARB laws), and federal (EPA) environmental laws before purchasing and installing any component.

  • 3.4 Absolute Indemnification: You agree to fully indemnify and hold Trinity Digital Company harmless from any federal fines, state citations, impound fees, or legal actions resulting from the illegal use of these parts on public highways.

SECTION 4 - DROPSHIPPING & THIRD-PARTY INVENTORY As a retailer utilizing a blind drop-shipping fulfillment model, we rely on inventory data and product specifications provided by third-party wholesale distributors and the original manufacturers. We are not responsible if information made available on this site is not perfectly accurate, complete, or current. Any reliance on the material on this site is at your own risk.

SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES Prices for our products are subject to change without notice due to manufacturer MSRP updates or supply chain volatility. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

SECTION 6 - BILLING, PAYMENT & SALES TAX TERMS

6.1 Secure Payment Processing & Methods Onyx Customs FL provides a safe and secure checkout experience. All transactions are processed through an encrypted, PCI-compliant payment gateway. We accept all major credit and debit cards, including Visa, Mastercard, American Express, and Discover. We do not collect, process, or store your full credit card information on our internal servers.

6.2 Time of Charge & Order Verification Your selected payment method will be authorized and charged in full immediately upon clicking "Complete Order" at checkout. To protect our customers from fraudulent transactions, our risk analysis system strictly verifies the matching of your Billing Address with the address on file with your credit card issuer. Orders with mismatched information may be placed on a temporary hold for manual verification.

6.3 Billing Statement Identification To ensure complete transparency, the charge for your purchase will appear on your credit card or bank statement under our registered DBA name: Onyx Customs FL.

6.4 Sales Tax Compliance (Florida Nexus) As a business operating within the State of Florida, Trinity Digital Company (d/b/a Onyx Customs FL) is legally required by the Florida Department of Revenue to collect and remit sales tax. Orders shipped to a destination within Florida will be charged the standard 6% state sales tax, plus any applicable county discretionary sales surtax based on the delivery zip code. Sales tax is calculated dynamically at checkout before you finalize your payment.

SECTION 7 - GEOGRAPHIC & COMPLIANCE RESTRICTIONS We reserve the right to limit the sales of our products to any person or geographic region. We actively employ geographic shipping blocks and will outright refuse to ship non-CARB compliant aftermarket parts to addresses within California or any Section 177 emission-adopting states.

PRODUCTS ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO CASE SHALL TRINITY DIGITAL COMPANY, OUR DIRECTORS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, OR ENGINE REPLACEMENT COSTS) ARISING FROM YOUR USE OF ANY PRODUCTS PROCURED USING THE SERVICE.

  • GOVERNING LAW: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

  • BINDING ARBITRATION: ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, YOUR PURCHASES, OR YOUR USE OF THE SITE SHALL BE SETTLED BY BINDING, INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN PALM BEACH COUNTY, FLORIDA. YOU EXPLICITLY WAIVE YOUR RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL.

  • CLASS ACTION WAIVER: YOU AND TRINITY DIGITAL COMPANY AGREE THAT ANY PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR CONSOLIDATED LEGAL ACTION.
